Taking legal action

If previous efforts to resolve a mater have failed or the nature of a incident is serious we may decide to take legal actions against both tenancy and individual. Which could include:

  • an injunction - a legal order that instructs the perpetrator to stop acting antisocially; or
  • an antisocial behaviour order banning the perpetrator from coming into specific areas; or
  • Demotion of Tenancy – a request to remove the security of your tenancy.
  • To extend your Introductory Tenancy – If you are have an Introductory Tenancy. This will usually be for 12 months. This action will make it 18 months before you can then enjoy the benefit of a secure tenancy.
  • Eviction

To take one of the above action we have to produce evidence to the court this can either be in the form of statements, nuisance diaries or video footage. For example if we applied to the courts for an eviction we would have to prove to the Judge that there was no other option but to give us possession of the tenancy back.
